Terms and Conditions for Qubit Creative Strategy

These terms and conditions govern your access to and use of Qubit Creative Strategy, including any content, functionality, and services offered on or through the website.

please read these terms carefully before using the website. by accessing or using the website, you agree to be bound by these terms and all applicable laws and regulations. if you disagree with any part of these terms, then you may not access the website.

1. Introduction

Welcome to Qubit Creative Strategy (“Company,” “we,” “our,” or “us”). By accessing or using our services, you (“Client,” “you”) agree to comply with and be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our services.

2. Services Provided

Qubit Creative Strategy offers marketing strategy, fractional CMO services, SEO, content marketing, paid media management, and related marketing consulting services. The scope of services will be outlined in a separate agreement or proposal provided to the Client.

3. Client Responsibilities:

Clients agree to:

  • Provide accurate and timely information necessary for project completion.
  • Respond to requests for approvals, feedback, and deliverables in a timely manner.
  • Ensure they have the necessary rights to any materials provided to Qubit Creative Strategy.
  • Comply with all applicable laws and regulations related to their business and marketing activities.

4. Payment Terms

Qubit Creative Strategy disclaims all warranties, express or implied, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Qubit Creative Strategy does not warrant that the website will be uninterrupted, secure, or error-free.

  • Payment terms and fees will be outlined in a separate service agreement or proposal.
  • Invoices are due within 30 days of receipt (Net 30) unless otherwise specified.
  • A 15% late fee may be applied to overdue invoices beyond 30 days.
  • Payments are accepted via EFT or credit card processing through Stripe, link provided on invoice or by request.

5. Refunds & Cancellations

  • All payments for services are non-refundable unless otherwise stated in the service agreement.
  • Either party may terminate an ongoing contract with 14 days’ written notice.
  • If a project is terminated before completion, the Client is responsible for payment for all work completed up to the termination date.

6. Intellectual Property 

The content on the website is protected by copyright, trademark, and other intellectual property laws. you may not modify, publish, transmit, reverse engineer, create derivative works from, or exploit in any way the content without the prior written permission of Qubit Creative Strategy.

  • All marketing strategies, deliverables, and creative assets developed by Qubit Creative Strategy remain Company property until full payment is received.
  • After full payment, the Client receives a non-exclusive, non-transferable license to use the materials as agreed upon in the contract.
  • Qubit Creative Strategy reserves the right to showcase non-confidential work in its portfolio unless otherwise agreed.

7. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the engagement, except when disclosure is required by law.

8. Limitation of Liability

  • Qubit Creative Strategy is not responsible for any indirect, incidental, or consequential damages resulting from the use of its services.
  • We make no guarantees of specific marketing performance or financial outcomes.

9. Indemnification 

Clients agree to indemnify and hold Qubit Creative Strategy harmless from any claims, damages, or expenses resulting from their use of our services, including but not limited to legal claims related to intellectual property, advertising compliance, or data usage.

10. Changes to the Terms 

Qubit Creative Strategy reserves the right to update these Terms at any time. Clients will be notified of significant changes via email or website updates.

11. Governing Law

These Terms shall be governed by the laws of the State of Colorado, without regard to conflict of law principles.
